Welcome to Are You Good. These Terms of Use ('Terms') govern your access to and use of the Are You Good mobile application and services (the 'Service'). By using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. ELIGIBILITY
You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you meet this age requirement.
2. NATURE OF SERVICE
Are You Good is a communications and notification tool designed to facilitate 'check-in' signals between users and their selected contacts. ARE YOU GOOD IS NOT AN EMERGENCY RESPONSE SYSTEM, MEDICAL DEVICE, OR MONITORING SERVICE. It does not contact emergency services (e.g., 911) and is not a substitute for professional care or safety equipment.
3. USER WARRANTY & CONTACT CONSENT
You are solely responsible for selecting and adding 'Check-in Contacts.' YOU REPRESENT AND WARRANT THAT YOU HAVE OBTAINED EXPRESS CONSENT FROM EACH CONTACT TO RECEIVE AUTOMATED SMS AND/OR EMAIL ALERTS FROM ARE YOU GOOD ON YOUR BEHALF. You agree to indemnify and hold Are You Good harmless from any claims arising from your failure to obtain such consent.
4. TECHNICAL REQUIREMENTS
To perform a 'check-in,' your device must have sufficient battery and an active cellular or data connection. While the Service's cloud infrastructure is designed to trigger alerts to your contacts if a check-in is missed (regardless of your device's status at that moment), the initial check-in signal cannot be sent without a functional device and signal.
5. PAYMENTS
Access to the Service and additional contacts are available via one-time in-app purchases processed through the Apple App Store or Google Play Store. All transactions are subject to the terms and conditions of the respective app store provider.
6. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Are You Good (registered in New York, NY) shall not be liable for any personal injury, wrongful death, or incidental damages resulting from missed alerts, technical failures, or reliance on the Service for safety purposes. This Service is provided 'AS IS.'
7. GOVERNING LAW
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.
