Are You Good is a communications and notification application designed to help users share "check-in" signals with selected contacts. Are You Good is not a medical device, health monitoring service, personal safety service, emergency response system, or substitute for professional care.
Not for emergencies
Do not use Are You Good for emergencies. Are You Good does not contact emergency services (for example, 911/112/999) and does not guarantee that alerts will be sent, delivered, received, seen, or acted upon in time (or at all).
No guarantee of delivery or response
Alerts and other messages may be delayed, not sent, misrouted, incomplete, inaccurate, or unavailable due to factors outside of Are You Good's control, including (without limitation) device settings, battery, connectivity, carrier issues, SMS delivery failures, operating system restrictions, outages, third-party service failures, user configuration, or human error.
User responsibility; assumption of risk
You are solely responsible for:
- selecting appropriate contacts, keeping contact information current, and ensuring your device/app settings allow notifications; and
- taking any actions you consider necessary for your health and safety.
By using Are You Good, you understand and agree that you assume all risks associated with relying on check-ins, reminders, and alerts.
No duty to protect; communications tool only
Are You Good provides a means to communicate and share notifications. Are You Good does not and cannot ensure any user's wellbeing or safety, and does not undertake any duty of care, supervision, monitoring, rescue, or protection for any user or any third party.
Limitation of liability
To the maximum extent permitted by applicable law, Are You Good and its owners, operators, employees, contractors, and partners will not be liable for any claim, loss, injury, damage, or harm arising out of or related to:
- any failure, delay, or error in sending, delivering, receiving, or acting upon any alert or notification;
- any decision made or action not taken by a user or contact after receiving (or not receiving) an alert; or
- any reliance on Are You Good for health, safety, supervision, or emergency purposes.
This includes, without limitation, indirect, incidental, special, consequential, exemplary, or punitive damages, and any loss of data, profits, goodwill, or personal injury or wrongful death claims, whether based in contract, tort, strict liability, or otherwise.
Statutory rights
Some jurisdictions do not allow certain exclusions or limitations of liability. Nothing in this disclaimer limits liability where doing so is prohibited by law, including for fraud or willful misconduct, or other liability that cannot be excluded under applicable consumer protection laws.
